This website is operated by Lacadivas Swimwear, a trade name of Tatiana Lucas, with tax identification number 234338881. The brand Lacadivas Swimwear assumes the responsibility and commitment to respect the security of this website and protect the data provided by customers.
These terms and conditions are supplemented and integrated, in all aspects not provided for in this document, by the Privacy Policy and the Cookie Policy, also available for consultation on this website.
Lacadivas Swimwear reserves the right to change these conditions, as well as modify at any time the information and commercial offer presented on products, prices, promotions, commercial terms, and services, with any changes being published on the website www.lacadivas.com.
The use of the website, whether as a user or customer, implies acceptance of the terms and conditions. If you do not agree with these terms and conditions, do not access the website or make online purchases at www.lacadivas.com.
**SECTION 2 - RESPONSIBILITY
All products and services sold on the website www.lacadivas.com comply with Portuguese law. The Store maintains adequate security levels; however, Lacadivas Swimwear will not be liable for any losses suffered by users/customers or third parties due to delays, interruptions, errors, or suspensions of communications originating from factors beyond its control. These factors may include deficiencies or failures caused by the communication network or communication services provided by third parties, computer systems, modems, connection software, or any computer viruses arising from file downloads containing viruses or other properties that may affect the user's equipment.
Lacadivas Swimwear shall not be responsible for any losses or damages caused by abusive use of the service that are not directly attributable to it due to willful misconduct or gross negligence. Lacadivas Swimwear is not liable for losses or damages resulting from non-compliance or defective performance of the service unless directly or indirectly attributable to it due to willful misconduct or gross negligence. Specifically, Lacadivas Swimwear disclaims responsibility for:
I) Errors, omissions, or other inaccuracies regarding the information provided through the service;
II) Damages caused by the user/customer or third parties, including violations of intellectual property;
III) Non-compliance or defective performance resulting from compliance with judicial decisions or administrative authorities;
IV) Non-compliance or defective performance resulting from force majeure events, i.e., extraordinary or unforeseeable events beyond Lacadivas Swimwear's control, such as fires, power outages, explosions, wars, riots, civil unrest, government decisions, strikes, earthquakes, floods, or other natural catastrophes or situations beyond Lacadivas Swimwear's control that prevent or impair the fulfillment of obligations.

**SECTION 3 - TERMS OF USE
The ordering of products must be done by users/customers aged 18 (eighteen) years or older (individuals under this age must have permission from their legal representatives).
The user/customer agrees to:
1. Provide accurate personal data and addresses;
2. Not use false identities;
3. Respect the ordering limits imposed;
4. Not introduce, store, or disseminate defamatory, obscene, injurious, xenophobic, and/or any other content through the Lacadivas Swimwear online store that violates general principles of law and public order.
Note: If any of the data provided is incorrect or insufficient, resulting in a delay or inability to process the order or eventual non-delivery, the responsibility lies with the user/customer, and Lacadivas Swimwear declines any liability. In case the consumer violates any of these obligations, Lacadivas Swimwear reserves the right to cancel future purchases and block access to the store. The use of products and services acquired for commercial purposes, including the resale of goods, is expressly prohibited.
**SECTION 4 - OUR PRODUCTS
Lacadivas products are 100% Portuguese-made, crafted with high-quality materials. Sustainability and quality are paramount in our selection of fabrics, knits, and accessories for our collections. We consistently strive to find more environmentally friendly solutions. Our collections are produced using recycled fabrics, and most of our items offer UV protection properties.
Our products are exclusive and limited. If an item is currently unavailable on the website, it may become available again in the future.
Lacadivas Swimwear sells its products with different sizes, such as a top size S and bottom size M. Users/customers have access to all size measurement charts in our SIZE GUIDE.
While we aim to make product images as realistic as possible, we cannot guarantee that the images displayed on your screen are a completely accurate representation of the actual merchandise due to technical differences in monitors or screens you may use, among other reasons. Variations in products may occur where raw materials or manufacturing processes influence the final product. For example, the placement of patterns on fabric may vary among final products of the same model.
The color of the product being different from what you viewed on the screen or the pattern of the print being distributed differently on the product you purchased is normal and does not indicate a defect in the product.
**SECTION 5 - HOW TO ORDER
1. **Select Your Item**: Navigate to the product page of the item you wish to purchase. Choose your desired size and click "Add to Cart". The item will be added to your shopping cart.
2. **Review Your Cart**: You can continue browsing and adding more items. Once you've added all the items you want to purchase, click on your shopping cart icon (located in the top right corner of your screen).
3. **Proceed to Checkout**: Review the items in your cart. Then, proceed to fill out the required fields and complete the payment process. You do not need to create an account to make a purchase at Lacadivas Swimwear.
4. **Confirmation Email**: After successfully completing your payment, you will receive an email confirming your order (please check your SPAM folder if necessary).

**SECTION 7 - EXCHANGE AND RETURN POLICY
All purchases made on the website www.lacadivas.com are subject to Portuguese legislation (Decree-Law No. 24/2014).
Lacadivas Swimwear accepts exchanges/returns of items within a maximum period of 14 business days after the order is received at the address chosen by the user/customer. For an exchange/return to be successfully processed, it is mandatory that the item is returned in perfect condition, exactly as it was sold, and accompanied by the original invoice, tags, pouch, cups, and any other elements included in the shipment.
We do not accept exchanges/returns of altered, washed, used, odorous, or otherwise damaged items due to misuse.
Lacadivas is not responsible for the misuse of its items or incorrect washing. We always recommend checking the washing care section before each purchase. Similarly, please consult the size guide section to make an informed purchase. Our customer support team is available to assist with any questions.
Reasons for which users/customers may request an exchange/return within the aforementioned period include:
1. The item is too big.
2. The item is too small.
3. I do not like the model.
4. I changed my mind.
5. The item is not as imagined.*
*Photographs are taken in high definition to accurately represent each product. Different devices may affect the color representation, so it may not correspond 100% to reality. In patterned items, the position of the design may vary within the same model. For more information, please refer to the details on each product page.
For online exchanges, the first exchange for each item is free (Check Online Exchange/Return Procedures). The exchange will only be processed upon receiving the item at our facilities and successfully passing our quality control.
For returns, all shipping costs are borne by the customer. We recommend sending items via registered mail for tracking purposes.

**SECTION 8 - ONLINE EXCHANGE/RETURN PROCEDURE
Please note that all exchanges/returns must follow the process outlined below.
**SECTION 8.1 - HOW TO MAKE AN ONLINE EXCHANGE:
1. If you wish to make an exchange, please contact our customer support via email at support@lacadivas.com. with the following information:
- Full name
- Invoice number and date or order number
- Reason for exchange (refer to the various reasons in the EXCHANGE AND RETURN section)
- Size/color of the item you wish to receive
- Email address for contact
- Phone number
- Shipping address where you want to receive your new item
2. Once the item arrives at our workshop and successfully passes our quality control, we will send out your new piece. You will be notified once it is dispatched from our workshop. If the product you wish to receive is more expensive than the previous one, you will need to pay the price difference via bank transfer.
**SECTION 8.2 - HOW TO MAKE AN ONLINE RETURN:
1. If you wish to make a return, please contact our customer support via email at support@lacadivas.com. with the following information:
- Full name
- Invoice number and date or order number
- Reason for return (refer to the various reasons in the EXCHANGE AND RETURN section)
- Email address for contact
- Phone number
- IBAN where you wish to receive the refund
2. Once the item arrives at our workshop and successfully passes our quality control, we will process the refund to the provided IBAN via email. Returns will be processed within a maximum of 10 business days after receiving the item at our workshop.
Please note:
- Only the value of the item chosen will be refunded, excluding shipping costs paid by the user/customer.
- Our store will not cover any customs duties or fees for returned items.
- Items sent for exchange/return without prior contact with customer support will not be accepted as such.
- Lacadivas Swimwear is not responsible for any losses during the exchange/return process. If goods are lost during the process, no exchange or return will be processed.
The refund process with Klarna typically takes 5 to 7 business days. Once Lacadivas registers your return or cancellation, you will receive your refund according to their refund policy.
Here are some additional details to keep in mind:
- Refunds are processed differently depending on your payment schedule status, the amount you paid, and whether a full or partial refund is processed.
- Note that express shipping fees are non-refundable as per the terms and conditions.
- For a full refund, any remaining payments will be canceled, and the amount already paid will be refunded to the provided bank account.
- If a partial refund is issued that exceeds the remaining balance of your order, the excess amount will be credited back to your original payment method.
- If the partial refund is less than the remaining balance, the amount will be deducted from the remaining balance, and the remaining payments will be adjusted accordingly. You can view all updates to your payment plan in our app.
- If you're still waiting for your refund, it may take up to 14 days for the refund to appear in your account, depending on your financial institution.
- To check the status of your refund, ensure that Lacadivas has updated your payment plan accordingly and then check your original payment method for the refund. If you haven't received the refund after 14 days or if your original payment method is linked to a closed bank account, contact customer service.
- If your payment plan hasn't been adjusted by Lacadivas, contact Lacadivas directly at support@lacadivas.com. to confirm the return or cancellation of your order.
**SECTION 9 - MANUFACTURING DEFECT
If a product you purchased from our online store has a defect, we sincerely apologize. We ask the user/customer to contact our customer support via email at support@lacadivas.com. with the following information:
- Full name
- Invoice number and date or order number
- Name and size of the item
- Description of the defect
- Explicit photos of the defect
- Email address for contact
- Phone number
The photos and description of the defect will be reviewed by our quality control team. If a manufacturing defect is confirmed, our customer support team will contact the user/customer to arrange for the item to be sent to our workshop (at no cost).
Upon receipt of the item at our workshop, our team will re-examine the defect. If it is indeed a manufacturing defect, our customer support team will provide an estimated timeframe for repair/replacement delivery.
If it is determined that the issue is not a manufacturing defect but rather misuse by the user/customer, Lacadivas Swimwear will not proceed with repairs. The return shipping of the item in question will be at the customer's expense.
**SECTION 10 - ORDER CANCELLATION
I. At the user/customer's request Users can cancel their order by contacting Lacadivas Swimwear via email at support@lacadivas.com, specifying the order number, provided that the order has not yet been processed. Once processed, Lacadivas Swimwear will attempt delivery, but the user/customer has the option to refuse it. For cancellation, the user/customer must provide the following information:
- Order number;
- Tax identification number used for the order;
- Delivery address.
II. By decision of Lacadivas Swimwear Lacadivas Swimwear reserves the right not to process orders if there are inconsistencies in the personal data provided or if misconduct is observed on the part of the buyer. Lacadivas Swimwear also reserves the right not to process any order or refund if there are errors in the prices and/or characteristics of the products due to technical problems or errors beyond Lacadivas Swimwear's control.
**SECTION 10 - MODIFICATIONS TO THE SERVICE AND PRICES
The prices of our products are subject to change without notice. We reserve the right to modify or discontinue the Service (or any part or content of it) at any time without notice. We shall not be liable to you or to any third party for any modification, price change, suspension, or discontinuance of the Service.
**SECTION 11 - PROMOTIONAL CODES (DISCOUNTS)
Promotional codes issued on the website www.lacadivas.com are subject to the following rules, particularly regarding their use, validity, and deadlines established for exercising the right to the promotion:
I) Grant the user/customer the right to benefit from a promotion or discount when purchasing a specific item or set of items; II) Are valid exclusively during the time period indicated on the promotional code or in the promotional campaign; III) Are valid exclusively for purchases made on the website www.lacadivas.com, and their use with regard to another brand, commercial entity, or any other entity is prohibited; IV) Cannot be combined with any other promotions or special offers; V) Are personal and non-transferable, therefore their sale, donation, assignment of contractual position, exchange, or transfer of promotional codes is prohibited; VI) Use of promotional codes for commercial purposes is prohibited; VII) Use of promotional codes in a manner contrary to the law, customs, and practices, or in a way that could harm the image, honor, reputation, and good name of Lacadivas Swimwear is prohibited; VIII) Cannot be exchanged for cash and are not reissued or refunded; IX) Lacadivas Swimwear reserves the right to consider any promotional code invalid if there is suspicion that it violates the conditions described above.
**SECTION 12 - SHIPPING/DELIVERY PROCESS
After successful payment, you will receive an email from Lacadivas Swimwear confirming your purchase. At that point, your order will begin processing and will be dispatched within the next three business days. (Following product launches, we appreciate your understanding for any delays due to high order volumes.)
Once your order leaves our workshop and reaches the CTT warehouses, you will receive a new email with your Tracking Number and estimated delivery day.
Delivery times vary depending on the shipping destination. Orders are delivered Monday through Friday, excluding local or national holidays, to the address provided during checkout (see table below).

We currently do not offer pre-paid duties and taxes so please be aware that if your shipping address is non-EU it could incur customs charges.
Providing an incorrect or incomplete delivery address may result in the return of the order to Lacadivas Swimwear and incur additional costs. We recommend always verifying your delivery address.
If you need to update your billing information or delivery address, please contact our Customer Support via email: support@lacadivas.com. within 24 hours.
**SECTION 14 - IS THERE ANY ADDITIONAL TAX OR CUSTOMS DUTY I NEED TO BE AWARE OF?
All Lacadivas orders are shipped from Portugal. Please be aware of any fees that may be charged to you by local customs if you are outside the EU. Visit your country's customs website for information. Lacadivas is not responsible for any applicable fees, import consumption taxes, or other charges levied by your country or postal service.
**SECTION 15 - CAN I RETURN MY ITEM(S)?
Certainly! While we hope you're pleased with our pieces, it's possible you may want to return something. In that case, just make sure everything is unworn and you're within the 2-week return window.
Products listed on sale with over 20% discount can only be returned for store credit or exchanges, not refunds. Any items listed in the final sale (outlet) cannot be returned or exchanged.
Please note, if you made your order in a "Buy X, Get 1 Free" promotion, we will only refund returns of more than 1 item. If 1 item is returned, we'll issue a refund as you received one item for free.
**SECTION 16 - CUSTOMS FEES FOR RETURNS OUTSIDE THE EU
If you are returning a product from outside the European Union (EU), please note that Lacadivas is not responsible for any customs fees incurred upon return. All such fees are the sole responsibility of the customer.
**SECTION 17 - CUSTOMS AND DUTIES
Be aware that your country or national postal service may charge additional customs fees, import taxes, or handling fees. Lacadivas is not responsible for any applicable taxes, value-added tax (VAT), import consumption taxes, or handling charges imposed by your country or postal service. Lacadivas is legally required to declare the full value in euros paid for international shipments. If the order is returned to the sender because it was refused by the recipient or not collected at the pickup point, the order may not be eligible for a refund. If issues arise, please contact your local postal service or customs authorities.
**SECTION 18 - INTELLECTUAL PROPERTY / APPLICABLE LAW
All contents of this website are the exclusive property of Lacadivas Swimwear and are therefore protected by copyright law.
In case of conflict, the consumer can resort to Alternative Dispute Resolution (ADR), which includes mediation, conciliation, and arbitration.
Please consult the list of Alternative Dispute Resolution Entities (ADR) under Law No. 144/2015 of September 8th, for more information.
